Our methodologies are based on current industry best practices and statistical analysis techniques. However, content strategy success depends on numerous factors beyond our control, and we cannot guarantee specific outcomes or results.
User Responsibilities
Account Information
Users are responsible for providing accurate and complete information when using our services. This includes business details, project requirements, and communication preferences necessary for effective service delivery. You must promptly update any changes to your information.
Appropriate Use
Our services must be used for legitimate business purposes only. Users agree not to engage in activities that could harm our platform, other users, or third parties. This includes respecting intellectual property rights and avoiding any unlawful or unethical practices.
Data Provision
When requesting analytics or consulting services, users must ensure they have proper rights to any data they provide for analysis. This includes obtaining necessary permissions for data use and ensuring compliance with applicable privacy regulations.
Intellectual Property Rights
All content, methodologies, analytical frameworks, and proprietary tools used in our services remain our intellectual property unless explicitly transferred through written agreement. This includes statistical models, content templates, and strategic frameworks developed for client projects.
Clients retain ownership of their original data and content provided for analysis. However, we may use aggregated, anonymized insights derived from client projects to improve our methodologies and services, provided such use does not identify specific clients or compromise confidential information.
Deliverables created specifically for client projects, such as custom reports and strategic recommendations, become client property upon full payment. However, underlying methodologies and analytical approaches remain our proprietary assets.
Users agree not to reverse engineer, copy, or distribute our proprietary methodologies without explicit written permission. This protection ensures we can continue developing innovative approaches to content strategy optimization.
Payment Terms
Service fees are specified in individual project agreements and must be paid according to agreed schedules. We accept various payment methods and provide clear invoicing for all services rendered. Late payments may result in service suspension or additional charges.
Refund policies vary by service type and are detailed in specific service agreements. Generally, refunds are not available for completed work or services that have been delivered according to agreed specifications.
Price changes for ongoing services will be communicated with appropriate notice, typically thirty days before implementation. Clients have the option to modify or terminate services before price changes take effect.
All fees are exclusive of taxes, which will be added as applicable according to local regulations. Clients are responsible for any additional costs associated with international transactions or special payment requirements.
Service Limitations
While we strive to provide accurate analyses and effective strategies, content marketing success depends on numerous external factors beyond our control. These include market conditions, competitive landscape, algorithm changes, and implementation quality.
Our recommendations are based on available data and current best practices, but we cannot guarantee specific results or outcomes. Client success depends significantly on proper implementation of recommended strategies and adaptation to changing market conditions.
Service availability may be affected by technical maintenance, updates, or unforeseen circumstances. We will make reasonable efforts to minimize service disruptions and provide advance notice when possible.
We reserve the right to refuse service or terminate agreements if we determine that a client's requirements are outside our expertise area or if continued service would not be in the client's best interest.
Confidentiality
We maintain strict confidentiality regarding client information, strategies, and business details shared during our professional relationship. This confidentiality extends to all team members and contractors involved in service delivery.
Clients are expected to maintain similar confidentiality regarding our proprietary methodologies, tools, and strategic approaches. This mutual confidentiality ensures protection of valuable business information for all parties.
Confidentiality obligations survive termination of our service relationship and continue indefinitely unless specifically released by written agreement between all parties.
Exceptions to confidentiality include legal requirements, court orders, or situations where disclosure is necessary to protect legitimate business interests or public safety.
Limitation of Liability
Our liability for any claims arising from our services is limited to the amount paid for the specific service giving rise to the claim. This limitation applies regardless of the legal theory under which claims are brought.
We shall not be liable for any indirect, incidental, special, or consequential damages, including lost profits, business interruption, or loss of data, even if we have been advised of the possibility of such damages.
Some jurisdictions do not allow limitation of liability for certain types of damages, so these limitations may not apply in all cases. Where limitations are not permitted, our liability will be restricted to the maximum extent allowed by applicable law.
These limitations reflect the analytical nature of our services and the inherent uncertainties in predicting content marketing outcomes in dynamic digital environments.
Termination
Either party may terminate service agreements according to terms specified in individual contracts. Generally, termination requires written notice and completion of any ongoing work or commitments.
We reserve the right to terminate services immediately if users violate these terms, engage in fraudulent activities, or if continued service provision becomes impractical or inadvisable.
Upon termination, users retain access to completed deliverables but forfeit rights to ongoing support or additional services unless specifically arranged through separate agreements.
Termination does not affect obligations that by their nature should survive, including payment obligations, intellectual property rights, and confidentiality requirements.
Governing Law
These terms are governed by the laws of the jurisdiction where our services are primarily delivered, without regard to conflict of law principles. Any disputes arising from these terms or our services will be resolved through appropriate legal channels in that jurisdiction.
Where possible, we prefer to resolve disputes through direct communication and negotiation. If formal dispute resolution becomes necessary, both parties agree to participate in good faith efforts to reach mutually acceptable solutions.
These terms represent the complete agreement between parties regarding service use and supersede all prior agreements or understandings, whether written or oral, relating to the subject matter.
